I can not play without English subtitles in the middle of the screen, am I missing something or is it hard coded?

I ran it through MPEG stream clip & it shows 2 Video tracks
1: English subtitles
2: Spanish subtitles
Ran it through Handbrake into .mp4 and English subtitles still stuck in the centre of screen.
Play both file types on PS3, DVR, Mac and all show subtitles with no way of turning off.
